Former Inmate Sues Washington State After Alleged Sexual Assault by Transgender Cellmate

Created: JANUARY 26, 2025

A former inmate of the Washington Corrections Center for Women has filed a lawsuit against the state, the Department of Corrections, and several prison officials, alleging she was repeatedly sexually assaulted by her transgender cellmate. The plaintiff, identified as Mozzy Clark, claims that 35-year-old Christopher Scott Williams, a biological male who identifies as female, harassed, threatened, and sexually assaulted her while they shared a cell.

The lawsuit alleges that Williams, who is 6'4", is a "violent, convicted sexual predator" with a history of sexual assault. Clark contends that prison officials were aware of Williams' history and the risks associated with placing a biological male in a women's prison, but failed to take appropriate action to protect her. The suit claims this negligence violated Clark's constitutional rights and subjected her to cruel and unusual punishment.

Clark alleges that Williams molested her while she slept, made sexually explicit comments and threats, and engaged in other disturbing behaviors. She claims she reported these incidents to prison officials, but they failed to intervene and even threatened to charge her with a hate crime if she went public with her allegations. The lawsuit also mentions that another female inmate had previously made similar accusations against Williams.

Clark's attorney, David Pivtorak, stated that the lawsuit aims to hold the Department of Corrections accountable for policies that endanger the safety of female inmates. He emphasized that the case is not just about Clark's individual experience, but about challenging policies that disregard the safety and dignity of women in prison. Williams' criminal history reportedly includes child molestation, assaulting a male prison guard, failing to register as a sex offender, and domestic abuse. Clark is seeking unspecified damages and legal costs.
