Arizona Congressman Eli Crane, a Republican and retired Navy SEAL, intends to introduce a resolution awarding Daniel Penny the Congressional Gold Medal. Penny, a Marine veteran, is currently on trial for the death of Jordan Neely, a homeless man, on a New York City subway. Crane believes Penny's actions represent a stand against a "corrupt system" and protected fellow passengers. He stated, "Mr. Penny bravely stood in the gap to defy this corrupt system and protect his fellow Americans."

The incident occurred in May 2023 when witnesses reported Neely, who had schizophrenia, exhibiting erratic behavior and making threatening statements on the subway. Penny restrained Neely in a chokehold, which ultimately resulted in Neely's death. Penny's defense maintains his actions were in self-defense and to protect other passengers, also questioning the direct link between the chokehold and Neely's death, citing the presence of K2 in Neely's system. Prosecutors, however, argue Neely posed no direct threat and blame Penny's actions for Neely's death, highlighting video footage showing the chokehold continuing after Neely stopped moving. The case has sparked debate regarding vigilantism and urban crime policies.

Crane's resolution commends Penny for protecting New Yorkers from violence and criticizes the Biden administration and local governments for failing to protect citizens from violent crime. The resolution highlights Penny's military service and portrays his actions as exceeding the call of civilian duty, restraining a "criminal" with 42 prior arrests and an active warrant.
