Biden to Veto GOP Bill Blocking Pistol Brace Regulation

Created: JANUARY 24, 2025

President Biden has stated his intention to veto a Republican-led bill aimed at preventing his administration from enforcing new regulations on pistol stabilizing braces. The bill, introduced by Rep. Andrew Clyde (R-GA), challenges a Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) rule that reclassifies pistols equipped with such braces as short-barreled rifles, thereby requiring a federal license for ownership.

The White House justifies the new regulation by arguing that pistol braces allow the gun industry to circumvent existing rules on short-barreled rifles, which are known for their increased accuracy and potential for harm. They cite instances where such modified pistols have been used in mass shootings, emphasizing the need for stricter control. The administration contends that short-barreled rifles pose a greater threat due to their concealability and accuracy compared to traditional pistols and long guns.

Conversely, critics of the ATF rule, including several pro-gun organizations and Rep. Clyde, argue that pistol braces are legitimate firearm attachments often used by individuals with disabilities. They point out that the ATF previously approved these braces and claim the new rule infringes upon Second Amendment rights. Rep. Clyde has characterized the regulation as an overreach of executive authority and a step towards disarming American citizens. The bill currently has significant support within the House, with nearly 200 cosponsors.

The timing of the bill's introduction has been a source of contention within the Republican party. Rep. Clyde has alleged that party leadership delayed bringing the bill to the floor due to his stance on the debt ceiling agreement. However, House Majority Leader Steve Scalise has denied these claims, attributing the delay to concerns about securing sufficient votes for its passage.
