DePape's Federal Trial for Pelosi Attack Set to Precede State Proceedings

The man accused of assaulting Paul Pelosi, husband of former House Speaker Nancy Pelosi, will face federal charges before his state trial. 42-year-old David DePape's federal trial, stemming from the October 2022 home invasion, is scheduled to commence on October 11th. He is charged with assaulting a family member of a federal official and attempted kidnapping of a federal officer.

DePape's attorney, Adam Lipson, confirmed the federal trial date during a state court appearance on Wednesday. A status hearing for the state case, where DePape faces charges of attempted murder, assault with a deadly weapon, and elder abuse, is set for September 13th. Lipson stated that he needs to review more evidence related to the state case and won't schedule a trial date until the federal proceedings conclude. The state trial was initially planned for this summer but has been postponed.

The October 2022 attack left 83-year-old Paul Pelosi requiring emergency surgery for a skull fracture. DePape has pleaded not guilty to both the federal and state charges. The incident unfolded at the Pelosis' San Francisco residence.

Previously released surveillance and bodycam footage shows police arriving at the Pelosi home and interacting with both Pelosi and DePape, who were holding a hammer together. After a brief exchange, DePape pulled the hammer away from Pelosi and struck him. Additional footage depicts DePape approaching the house, dropping bags, retrieving what appears to be a hammer, and breaking into the residence.
