During the CNN segment, Tapper recalled Schiff's aggressive questioning of Trump's attorney general nominee, Pam Bondi, where Schiff attributed declining trust in the Justice Department to Republican attacks. Tapper countered, noting that Democrats, including Schiff, have also targeted the DOJ.

Tapper then brought up Biden's critical remarks about the Hunter Biden investigation, suggesting the President had undermined the DOJ. He contrasted this with Schiff's harsh stance against Hur for his description of Biden. Hur's phrasing, while potentially unflattering, was seemingly validated by the President's own words.
Schiff defended his criticism, arguing that Hur's inclusion of personal observations in a prosecutorial memo was inappropriate and politically motivated. He maintained that he calls out deviations from DOJ policy, regardless of the source, and reiterated his disagreement with Biden's remarks on his son's case.

Tapper suggested that Hur's characterization of Biden served to explain his decision not to prosecute, despite finding Biden's retention of classified documents to be a willful violation of law. Hur attributed his decision to Biden's diminished mental capacity, which he anticipated would influence a jury's perception.

Tapper referenced Schiff's previous, pointed attack on Hur during a March hearing, where Schiff accused Hur of intentionally disparaging Biden with politically charged language. Schiff had argued that Hur's phrasing, particularly his subjective opinion of the president, was designed for maximum political impact and was ultimately amplified by Biden's opponents.
