In response to the tragic murder of 12-year-old Jocelyn Nungaray, Senator Ted Cruz and Representative Troy Nehls have reintroduced the "Justice for Jocelyn Act." This legislation aims to prioritize public safety by mandating that all available Immigration and Customs Enforcement (ICE) detention beds be filled before releasing any undocumented immigrants into the U.S. interior. Furthermore, even with full capacity, the Department of Homeland Security (DHS) would be required to exhaust all other options, such as GPS monitoring, before releasing individuals.

Two individuals allegedly in the country illegally are facing capital murder charges in connection with Nungaray's death. Reports indicate they were released on recognizance while awaiting immigration hearings. Cruz emphasized the preventable nature of this tragedy, attributing it to open-border policies that left ICE detention beds empty. He expressed his commitment to working alongside Jocelyn's mother, Alexis Nungaray, to seek justice and enhance community safety.

Nehls echoed Cruz's sentiments, highlighting the importance of prioritizing American safety and urging Congress to swiftly pass the legislation. He called for the bill to be sent to the President's desk as soon as possible. This renewed push for stricter immigration enforcement comes amid other legislative efforts, such as the Laken Riley Act, which focuses on detaining undocumented immigrants accused of theft-related offenses, and Sarah’s Law, aimed at detaining those charged with homicide. The incoming Trump administration is anticipated to initiate a significant deportation operation upon taking office, with support from Congressional Republicans.
